Assignment for shared use of frequencies, trialling of innovative technologies, short-term frequency needs

(1) Frequencies for which efficient use by a single party alone is not to be expected may also be assigned to several parties for shared use. The holders of these rights of use of frequencies must accept impairments arising from proper shared use of the frequency.
(2) In justified individual cases, in particular for trialling innovative technologies in telecommunications, or in the case of short-term frequency needs, the determinations contained in the Frequency Plan may be departed from for a limited period in assigning frequencies. This is conditional on no use of frequencies being adversely affected. Where interests of the Länder are affected in the transmission of broadcasting within the area of responsibility of the Länder, agreement is to be established with the competent Land authority on the basis of the broadcasting-law determinations.
