Functions and rights of the Advisory Council

(1) The Advisory Council under section 5 of the Act on the Federal Network Agency for Electricity, Gas, Telecommunications, Post and Railways has the functions and rights named in the following subsections.
(2) The Advisory Council participates in the Federal Network Agency's decisions in the cases under section 100(4), points 2 and 4.
(3) The Advisory Council is entitled to apply for measures to implement the regulatory objectives and to ensure the right to the provision of telecommunications services under Part 9. The Federal Network Agency is obliged to decide on the application within six weeks.
(4) The Advisory Council is entitled to obtain information and statements from the Federal Network Agency. The Federal Network Agency is obliged to provide information to the Advisory Council.
(5) The Advisory Council is to be heard in drawing up the Frequency Plan under section 90.
