(1) Invoices to end users must contain: 1. the specific description of the services invoiced; 2. the name and address for service of the invoicing provider; 3. in the case of an invoicing provider established abroad, additionally the address for service of a domestic agent generally authorised to accept service; and 4. a national geographic telephone number or a free-of-charge customer service telephone number, email address, and website of the invoicing provider.
(2) Where third-party claims or assigned claims of third parties (third-party providers) are itemised, invoices to end users must additionally contain: 1. the name and address for service of the third-party provider; 2. a national geographic telephone number or a free-of-charge customer service telephone number of the third-party provider; 3. a reference to a website containing the following easily found information about the third-party provider: a) email address, b) address for service of the third-party provider, c) in the case of a third-party provider established abroad, additionally the address for service of a domestic agent generally authorised to accept service. Section 65 remains unaffected. Where the end user pays the total amount of the invoice to the invoicing provider, that payment also discharges the payment obligation to the third-party provider.
(3) Unless the end user has specified otherwise before or at the time of payment, partial payments to the invoicing provider are to be set off against the claims itemised in the invoice in proportion to their share of the invoice's total claim.
(4) The invoicing undertaking must draw the invoice recipient's attention, in the invoice, to the recipient's right to raise reasoned objections to individual claims made in the invoice.
(5) The Federal Network Agency determines, after hearing the undertakings, professional circles, and consumer associations concerned, procedures that providers of publicly available mobile services and providers of connections to the public mobile network must apply in order to use identification of a mobile connection for taking up and billing a service provided alongside the call. These procedures should effectively protect the end user against a service provided alongside the call being taken up and billed against the end user's will. The Federal Network Agency publishes the procedures and reviews their effectiveness at regular intervals.
