Information on future network deployment

(1) Information on future network deployment for the mobile communications sector is based on geographic surveys that the Central Information Office of the Federation conducts for the purpose of compiling an overview of the future deployment of public telecommunications networks intended for mobile communications. The surveys under the first sentence comprise information showing the sites at which a mobile network operator intends, within 12 months of the start of the respective survey, to deploy the mobile network it operates in the areas shown, by the map under section 52(1), first sentence, point 6, as not covered by third, fourth, or fifth generation mobile technologies.
(2) The Central Information Office of the Federation conducts the surveys at regular intervals, but at intervals of at least six months from the first survey.
(3) The information to be collected under subsection (1) comprises:
1. geographic site coordinates or, where no building permit has yet been applied for a specific site, sufficiently precise particulars of search areas for site planning, and
2. particulars of the coverage to be expected. The Federal Ministry for Digital Affairs and State Modernisation, in agreement with the Federal Ministry for Economic Affairs and Energy, lays down requirements as to the technical details of the matters referred to in subsection (1), second sentence, and the first sentence of this subsection, in a Technical Guideline published in the Transport Gazette.
(4) The Central Information Office of the Federation may, at the request of the Federal Ministry for Digital Affairs and State Modernisation, prepare, on the basis of the geographic survey, an overview for a specified period concerning the future local availability of other public telecommunications networks, where the Central Information Office of the Federation identifies and gives reasons for a need for such a survey.
(5) Information on future network deployment within the meaning of subsection (1) comprises all relevant information on planned network deployment measures, including the network deployment plans of all undertakings and public bodies. The information collected must satisfy the requirements of section 80(2), second sentence, and be treated in accordance with section 80(3). The first and second sentences apply correspondingly to information required for the overview of future availability of other public telecommunications networks within the meaning of subsection (4).
(6) The Central Information Office of the Federation may grant regional and local authorities access to the overview under subsections (1) and (4) for general planning and funding purposes. Further details are regulated by the Central Information Office of the Federation in conditions for access, which ensure that the information is treated confidentially, subject to safeguarding public security and business and trade secrets.
