Participation in the Radio Spectrum Policy Group

(1) Where the Federal Network Agency intends to conduct an award procedure under section 91(9) in conjunction with section 100 in respect of harmonised frequencies for wireless broadband networks and services, or measures under section 105(2), it informs the Radio Spectrum Policy Group of the corresponding draft decisions or draft measures at the same time as their publication in the hearing procedure.
(2) When giving the information under subsection (1), the Federal Network Agency states whether, and if so when, it requests the Radio Spectrum Policy Group to convene a peer review forum under Article 35 of Directive (EU) 2018/1972.
(3) Where the Radio Spectrum Policy Group convenes a peer review forum under Article 35(2) of Directive (EU) 2018/1972, the Federal Network Agency explains the draft measure under Article 35(4) of Directive (EU) 2018/1972.
