Publication and transmission of information

(1) The Central Information Office of the Federation publishes the information from the geographic survey under section 80, insofar as the information is not available on the market. In doing so, it must safeguard business and trade secrets and comply with the Re-use of Public Sector Information Act of 13 December 2006 (Federal Law Gazette I, p. 2913), as amended by Article 1 of the Act of 8 July 2015 (Federal Law Gazette I, p. 1162). Rights of access under this Act remain unaffected.
(2) The Central Information Office of the Federation transmits the information under sections 79 to 83, on request, to other public bodies responsible for performing functions under this Act, provided that the requesting body ensures the same degree of confidentiality and protection of business and trade secrets as the Central Information Office of the Federation. The parties that provided the information are to be informed of the possibility of the information being transmitted under the first sentence. Subject to the conditions of the first and second sentences, the information is made available, on request, to BEREC and the Commission.
