Interoperability of television and radio equipment

(1) Every digital television reception device offered for sale, hire, or otherwise made available must, insofar as it contains an integrated screen whose visible diagonal exceeds 30 centimetres, be equipped with at least one interface socket that has been adopted by a recognised European standards organisation, or that complies with a common, industry-wide, open specification, and that permits the connection of peripheral devices and the possibility of conditional access.
(2) Every digital television reception device offered for sale, hire, or otherwise made available that is capable of receiving and decrypting digital television signals must have the capability to 1. decrypt signals complying with a common European encryption algorithm, as administered by a recognised European standards organisation; 2. display signals transmitted unencrypted, provided that, in the case of hired devices, the hire contract terms are complied with by the hirer.
(3) Every car radio built into a newly placed on the market motor vehicle with at least four wheels, designed and constructed for the carriage of passengers, must contain a receiver, in accordance with the state of the art, that enables at least the reception and reproduction of radio services broadcast via digital terrestrial broadcasting. For receivers that comply with harmonised standards, or parts thereof, whose references have been published in the Official Journal of the European Union, conformity is presumed with the requirement in the first sentence corresponding to the standards, or parts thereof, concerned.
(4) Every radio device intended for consumers that is first offered for sale, hire, or otherwise made available on the market, that is predominantly intended for the reception of sound broadcasting, that is able to display the name of the programme, and that does not fall under subsection (3), must contain a receiver enabling at least the reception and reproduction of digital radio services. Excluded from this are 1. kits for radio equipment, 2. devices that form part of radio equipment of the amateur radio service, and 3. devices in which the radio receiver has a purely ancillary function.
(5) Providers of digital television services must take back, free of charge and without difficulty, digital television reception devices that they make available to their end users in connection with the use of digital television services. This does not apply where the device is fully interoperable with the digital television services of the provider to which the end user has switched. Conformity with the interoperability requirements is presumed for digital television reception devices that, at the time the contract ends, comply with the relevant harmonised standards, or parts thereof, whose references have been published in the Official Journal of the European Union. The provisions of the Electrical and Electronic Equipment Act remain unaffected.
