Negotiations on access and interconnection

(1) Operators of public telecommunications networks are entitled, and, on request by other undertakings, obliged, to negotiate with them on an offer of access and interconnection, in order to ensure the communication of users, the provision of telecommunications services, and their interoperability throughout the territory of the European Union.
(2) Information obtained during or after negotiations or agreements on access and interconnection under subsection (1) may be used only for the purposes for which it was provided. The information may not be passed on to third parties, in particular not to other departments, subsidiaries, or business partners of the parties involved in the negotiations.
(3) On the application of parties under subsection (1), the Federal Network Agency may be engaged as a neutral mediator in the negotiations, where the state of competition so requires.
