(1) The Federal Network Agency and other authorities competent under this Act provide the Commission, on its reasoned request, with the information the Commission needs to perform its functions under the Treaty on the Functioning of the European Union. Where the information provided relates to information previously provided by undertakings at the authority's request, the undertakings are informed of this.
(2) The Federal Network Agency and other authorities competent under this Act may provide information transmitted to them to BEREC and to authorities of another Member State of the European Union, on their reasoned request, insofar as this is necessary to enable BEREC or those authorities to fulfil their obligations under European Union law.
(3) In the course of the exchange of information under subsections (1) and (2), the Federal Network Agency and other authorities competent under this Act ensure confidential treatment of all information transmitted that is regarded as confidential under the provisions of the European Union and the Member States of the European Union on business secrets.
(4) The Federal Network Agency and other authorities competent under this Act mark confidential information in the course of providing information to the Commission, to authorities of other Member States of the European Union, and to BEREC. They may apply to the Commission for the information they provide to the Commission not to be made available to authorities of other Member States of the European Union. The application is to be given reasons.
