Price announcement

(1) A person who determines the price payable by the end user for the use of 1. voice-based premium services, 2. short code voice services, 3. voice-based directory enquiry services, and 4. voice-based carrier selection, must, before the charge begins to accrue, announce to the end user the price payable for use of that service, either time-dependently per minute or time-independently per data volume or other use, including value added tax and other price components. For voice-based carrier selection, the price is to be announced consistently in euros or in cents; switching between announcing the price in euros and in cents is not permitted.
(2) The price announcement under subsection (1) is to be completed no later than three seconds before the charge begins to accrue, with a reference to the point in time at which it begins. Where this price changes during use of the service, the price payable following the change is to be announced in accordance with subsection (1) and the first sentence before the start of the new tariff segment, provided that the announcement may also be made during use of the service. Where holding queues are used under section 115(1), point 5, neither the start nor the end of the holding queue constitutes a change of price within the meaning of the second sentence, provided that the price payable by the end user within the meaning of subsection (1), first sentence, for the tariff segment following the holding queue is unchanged from the price for the tariff segment before the holding queue.
(3) For use of voice-based mass traffic services, the service provider must announce to the end user the price payable for use of that service in accordance with subsections (1) and (2). By way of derogation from the first sentence, the price announcement may be made immediately after use of the service where the price does not exceed EUR 1 per minute or use.
(4) In the case of onward connection by a voice-based directory enquiry service, the obligation to announce the price under subsection (1) also applies, for the call being connected onward, to the directory enquiry service provider. The announcement may be made during use of the voice-based directory enquiry service, but must be made before the onward connection; subsection (2), second and third sentences, apply correspondingly. Reference must be made to the liability to pay charges for any holding queues resulting from the onward connection, and to the fact that any price announcements to the contrary made in the course of the holding queues are without effect. Where the onward connection is to a free-of-charge telephone service, reference must be made to the fact that any indications of being free of charge are without effect.
