Areas with a deployment deficit

(1) For general planning and funding purposes, the Central Information Office of the Federation may designate geographically clearly delimited areas for which it is determined, on the basis of the information collected under sections 80 and 81, that, during the period covered by the information on future network deployment,
1. no undertaking and no public body is deploying, or plans to deploy, a very high capacity network, and
2. no significant modernisation or expansion of the telecommunications network aimed at higher download speeds is planned. The Central Information Office of the Federation publishes which areas it has designated under the first sentence.
(2) The Central Information Office of the Federation may request undertakings and public bodies to declare their intention to deploy very high capacity networks within the area designated under subsection (1), first sentence, during the relevant forecast period. Where an undertaking or public body then declares an intention within the meaning of the first sentence, the Central Information Office of the Federation may request other undertakings and public bodies to declare any intention of theirs to
1. deploy very high capacity networks in that area, or
2. carry out significant modernisation or expansion of their telecommunications network aimed at higher download speeds. The Central Information Office of the Federation states which information must be contained in the declaration of intent so that it satisfies at least the requirements of section 80(2), second sentence. The Central Information Office of the Federation informs any undertaking or public body, on request, whether the designated area is, or is likely to be, served by a next-generation network, on the basis of the information collected under sections 80 and 81, stating the order of magnitude of the respective download speeds, insofar as this information is available to the Central Information Office of the Federation.
(3) Measures under subsection (2) are carried out under an efficient, objective, transparent, and non-discriminatory procedure from which no undertaking is excluded from the outset.
