Trade or business secrets

Immediately after submitting documents in the course of the Decision Chamber procedure, all parties must mark the parts that contain trade or business secrets. In that case, they must additionally submit a version that, in their view, can be inspected without disclosing trade or business secrets. Where this submission is not made, the Decision Chamber may assume that the party consents to inspection, unless particular circumstances are known to it that do not justify such an assumption. Where the Decision Chamber considers the marking of documents as containing trade or business secrets unjustified, it must hear the parties who submitted them before deciding on granting inspection to third parties.
