Access obligation and interconnection where there is control over access to end users

(1) The Federal Network Agency may 1. require undertakings that control access to end users to interconnect their telecommunications networks with those of other undertakings, insofar as this is necessary to ensure end-to-end connectivity and the provision of services and their interoperability; 2. impose further obligations on such undertakings, insofar as this is necessary to ensure end-to-end connectivity or to ensure interoperability.
(2) The Federal Network Agency may require providers of number-independent interpersonal telecommunications services to make their services interoperable, where the following conditions are satisfied: 1. the number-independent interpersonal telecommunications services have significant coverage and user uptake; 2. end-to-end connectivity between end users is at risk owing to a lack of interoperability between interpersonal telecommunications services; 3. the obligations are necessary to ensure end-to-end connectivity between end users; and 4. the Commission has adopted implementing measures under Article 61(2), second subparagraph, point (ii), of Directive (EU) 2018/1972.
(3) The Federal Network Agency may require operators to grant access to application programming interfaces and electronic programme guides on fair, reasonable, and non-discriminatory terms, insofar as this is necessary to ensure end users' access to digital radio and television services and related ancillary services.
(4) The measures of the Federal Network Agency under subsections (1) to (3) must be fair, objective, transparent, proportionate, and non-discriminatory.
(5) The procedures of section 14 apply correspondingly to measures imposed under subsections (1) to (3). The Federal Network Agency reviews the measures adopted within five years of the date on which they were imposed, as to their effectiveness and as to whether their amendment or withdrawal would be appropriate.
