(1) The Federal Network Agency submits to the Federation's legislative bodies a report on its activity and on the situation and development in the field of telecommunications. The report is to be submitted together with the sector report under subsection (2). The report must also address the development and level of end-user prices for telecommunications services under section 157(2), and the availability of the minimum service offering of these services.
(2) The Monopolies Commission draws up a sector report every two years, in which it assesses the state and foreseeable development of competition and the question of whether sustainably competition-oriented telecommunications markets exist in the Federal Republic of Germany, evaluates the application of the provisions of this Act on regulation and competition oversight, and comments on other current competition-policy issues.
(3) The sector report should be completed by 30 November of a year in which no main report under section 44 of the Competition Act is submitted. The Monopolies Commission may inspect the files kept by the Federal Network Agency, including trade and business secrets, insofar as this is necessary for the proper performance of its functions. Section 46(3) of the Competition Act applies correspondingly to the confidential treatment of the files. The Federal Government comments on the sector report to the Federation's legislative bodies within a reasonable period.
