Confidentiality of procedures; processing of information and granting of access for inspection

(1) Information obtained in the course of the procedures under this Division may be used only for the purposes for which it is provided. The information may not be passed on to third parties, in particular not to other departments, subsidiaries, or business partners of the parties involved in the negotiations. The parties to the procedure must safeguard the trade and business secrets obtained from the negotiations or agreements.
(2) The Federal Ministry for Digital Affairs and State Modernisation may process the information it has received for performing its functions under section 78(1), points 1 and 5, and, on application, grant parties involved in the deployment of public utility networks access to the processed information. Subsection (1) applies correspondingly to the use of information obtained under the first sentence.
