Obligated parties; compensation

(1) The obligations to store traffic data, to use the data, and to ensure data security under sections 176 to 181 relate to providers of publicly available telecommunications services for end users that are not number-independent interpersonal telecommunications services. A provider under the first sentence that does not itself generate or process all of the data to be stored under sections 176 to 181 must 1. ensure that the data not generated or processed by it itself in providing its service are stored in accordance with section 176(1), and 2. notify the Federal Network Agency, on its request, without delay, of who stores these data.
(2) Reasonable compensation is to be paid for necessary expenditure incurred by the obligated parties in implementing the requirements of sections 176, 178 to 181, insofar as this appears warranted to avert or offset unreasonable hardship. The costs actually incurred are decisive for assessing the compensation. The Federal Network Agency decides on applications for compensation.
