Use of the data

(1) The data stored under section 176 may 1. be transmitted to a prosecuting authority, insofar as it demands the transmission by invoking a statutory provision permitting it to collect the data named in section 176 for the prosecution of particularly serious criminal offences; 2. be transmitted to a hazard prevention authority of a Land, insofar as it demands the transmission by invoking a statutory provision permitting it to collect the data named in section 176 to avert a concrete danger to the life, limb, or liberty of a person, or to the existence of the Federation or a Land; 3. be used by the provider of publicly available telecommunications services for information under section 174(1), third sentence.
(2) The data stored under section 176 may not be used by the parties obligated under section 175(1) for purposes other than those named in subsection (1).
(3) Transmission of the data takes place in accordance with the statutory instrument under section 170(5) and the Technical Guideline under section 170(6). The data are to be marked so that it is recognisable that they are data that were stored under section 176. After transmission to another body, the marking is to be maintained by that body.
