Maximum price limits

(1) Prices for connections and services billed time-dependently via telephone numbers for premium services, short code services, and directory enquiry services may be charged only where they amount, in total, to no more than EUR 3 per minute, insofar as differing prices cannot be charged under subsection (6). This also applies in the case of onward connection by a directory enquiry service. Billing may take place in units of no less than 60 seconds. The third sentence applies correspondingly to carrier selection.
(2) Prices for connections and services billed time-independently via telephone numbers for premium services, short code services, and directory enquiry services may be charged only where they amount to no more than EUR 30 per connection, insofar as differing prices cannot be charged under subsection (6).
(3) Where the price for services billed via telephone numbers for premium services, short code services, and directory enquiry services is composed of time-dependent and time-independent components, these price components must either be shown separately in the itemised bill, insofar as one is issued, or the procedures under subsection (6), third sentence, must be applied. The price under the first sentence may amount to no more than EUR 30 per connection, insofar as differing prices cannot be charged under subsection (6).
(4) Prices for calls to service-number services may be charged only where they amount to no more than EUR 0.14 per minute or EUR 0.20 per call, insofar as differing prices cannot be charged under subsection (6). Billing may take place in units of no less than 60 seconds.
(5) Prices for calls to national subscriber numbers and personal numbers may be charged only where they amount to no more than EUR 0.09 per minute, insofar as differing prices cannot be charged under subsection (6). Billing may take place in units of no less than 60 seconds.
(6) Prices exceeding the price limits under subsections (1) to (3) may be charged only where the customer identifies themselves to the provider by a suitable procedure before using the service. The Federal Network Agency regulates the details. It may, by general order, lay down details on permissible procedures relating to tariffing under subsections (1) to (5). The Federal Network Agency may, in addition, in accordance with the procedure under section 123(7), determine maximum price limits departing from subsections (1) to (5), where the general development of prices or of the market makes this necessary.
