(1) Anyone who commercially operates public telecommunications networks or commercially provides publicly available telecommunications services, other than number-independent interpersonal telecommunications services, must notify the Federal Network Agency without delay of the intended commencement, alteration, and termination of that activity, and of changes to its name or business name, its legal form, and its address. The notification must be made in writing or electronically.
(2) The notification is made using a form prescribed and published by the Federal Network Agency.
(3) On application, the Federal Network Agency confirms, within one week, the completeness of the notification under subsection (2), and certifies that the undertaking is entitled to the rights conferred by, or under, this Act.
(4) The Federal Network Agency regularly publishes on its website a register of notified undertakings, including a brief description of the notified activity.
(5) Where it is clearly established that an undertaking has ceased business activity, and the termination of the activity has not been notified to the Federal Network Agency within six months, the Federal Network Agency may determine the termination of the activity of its own motion.
(6) The Federal Network Agency transmits the form data received under subsection (2) to BEREC by electronic means.
