Interface descriptions of operators of public telecommunications networks

(1) Operators of public telecommunications networks are required to 1. provide and publish adequate and accurate technical descriptions of their network access interfaces, and notify them directly to the Federal Network Agency, and 2. regularly publish all updated descriptions of these network access interfaces, and notify them directly to the Federal Network Agency. The obligation under the first sentence, point 1, also applies to every technical alteration of an existing interface.
(2) The interface descriptions must be sufficiently detailed to enable the design of telecommunications terminal equipment capable of using all services provided via the corresponding interface. The intended purpose of the interfaces must be stated. The interface descriptions must contain all information enabling manufacturers to carry out, at their own choice, the relevant tests relating to the interface-relevant essential requirements applicable to the telecommunications terminal equipment concerned.
(3) The publication obligation under subsection (1) is satisfied where the particulars are published in the Official Gazette of the Federal Network Agency. Where publication takes place elsewhere, the operator of the public telecommunications network must notify the reference to the Federal Network Agency without delay. In that case, the Federal Network Agency publishes the reference in its Official Gazette or on its website.
(4) Where publication of the complete interface descriptions is unreasonable owing to their extent, it is sufficient to publish a notice giving at least information on the nature and intended purpose of the interface and a reference to how the complete interface description may be obtained. The operator of the public telecommunications network ensures that interface descriptions are provided to interested parties without delay on request, and that interested parties are not treated unequally as to timing, content, or the cost of obtaining the interface descriptions. A charge levied for obtaining interface descriptions may be levied only up to the amount of the special costs thereby incurred.
(5) The operator of a public telecommunications network may offer services to be provided via the interfaces published under subsection (1) only where the interface description, or the reference to the interface description, has previously been published in the Official Gazette of the Federal Network Agency.
