Dialling programs (dialers)

(1) Dialling programs that establish connections to a number where, in addition to the telecommunications service, content is billed (dialers), are not permitted.
(2) For the use of dialling programs used by the caller to establish connections to a number where, in addition to the telecommunications service, no content is billed (telephony dialers), the Federal Network Agency lays down procedures and limit values to protect called parties from unreasonable nuisance caused by call attempts. This is determined by general order. Before the determination, the undertakings concerned, trade circles, and consumer associations are to be heard.
(3) The procedures and limit values determined under subsection (2) must be complied with no later than one year after their entry into force, unless a different implementation period is set in the determination. From that point on, telephony dialers may be used only where the procedures and limit values determined by the Federal Network Agency are complied with. The Federal Network Agency reviews the effectiveness of the determined procedures and limit values at regular intervals.
