International functions

(1) In the field of European and international telecommunications policy, in particular in participating in European and international institutions and organisations, the Federal Network Agency acts on behalf of the Federal Ministry for Digital Affairs and State Modernisation or the Federal Ministry for Economic Affairs and Energy. This does not apply to functions that the Federal Network Agency performs under its own responsibility on the basis of this Act or other Acts, or on the basis of regulations of the European Union.
(2) The Federal Network Agency informs the Federal Ministry for Digital Affairs and State Modernisation or the Federal Ministry for Economic Affairs and Energy in advance of the material content of planned meetings in European and international bodies. It summarises the material results and conclusions of the meetings and transmits them without delay to the Federal Ministry for Digital Affairs and State Modernisation or the Federal Ministry for Economic Affairs and Energy. For functions that the Federal Network Agency performs under its own responsibility under subsection (1), second sentence, the first and second sentences do not apply insofar as mandatory provisions require confidential treatment of information.
