(1) Where facts justify the assumption that the obligations in the field of access under Division 2, Subdivision 2, and under Division 3 would not lead to the achievement of the objectives of section 2 and the development of a sustainably competitive downstream retail market, the Federal Network Agency may also impose obligations on undertakings in a retail market in which the undertaking holds significant market power.
(2) The Federal Network Agency may also subject charges for end-user services to charge regulation under subsection (1); Division 3 applies correspondingly.
