Surcharge in health insurance

Where a contract for substitutive health insurance was concluded before 1 January 2000, section 149 applies on the understanding that 1. the surcharge is to be levied for the first time on 1 January of the calendar year following 1 January 2000, 2. the surcharge amounts to 2 percent of the gross premium in the first year, and increases by 2 percent on each subsequent 1 January, but not to more than 10 percent of the gross premium, unless it ceases to apply on reaching the age of 60, 3. the insurance undertaking is obliged to inform the policyholder, in good time before the surcharge is first levied, of its amount and the annual increases, and 4. the surcharge is levied only where the policyholder does not object in writing or electronically within three months of receiving the notification under point 3.
