(1) The supervisory authority cooperates with the European Insurance and Occupational Pensions Authority under Regulation (EU) No 1094/2010, for the purposes of Directives 2009/138/EC and (EU) 2016/2341. It takes account, as far as possible, of its guidelines and recommendations, and gives reasons for any deviations.
(2) The supervisory authority transmits the following particulars annually to the European Insurance and Occupational Pensions Authority: 1. the average capital add-on per undertaking, and the distribution of the capital add-ons set by the supervisory authority during the preceding year, measured as a percentage of the Solvency Capital Requirement and shown separately as follows: a) for all insurance undertakings, b) for life insurance undertakings, c) for non-life insurance undertakings, d) for insurance undertakings active in both life insurance and non-life insurance, and e) for reinsurance undertakings; 2. for each communication within the meaning of point 1, the proportion of the capital add-ons that were respectively set under section 301(1), points 1, 2, and 3; 3. the number of insurance undertakings that are partially exempted from regular supervisory reporting, and the number of insurance undertakings that are wholly or partially exempted from item-by-item reporting, together with the volume of their capital requirements, contributions, technical provisions, and assets, each measured as a percentage share of the total volume of the capital requirements, contributions, technical provisions, and assets of the insurance undertakings, and 4. the number of groups that are partially exempted from regular reporting, and the number of groups that are wholly or partially exempted from item-by-item reporting, together with the volume of their capital requirements, contributions, technical provisions, and assets, each measured as a percentage share of the total volume of the capital requirements, contributions, technical provisions, and assets of all groups.
(3) The supervisory authority informs the European Insurance and Occupational Pensions Authority of national supervisory provisions that are relevant to the field of occupational retirement provision schemes, insofar as these are not national social-law or employment-law provisions. The supervisory authority notifies the authority regularly, at least every two years, of changes to the content of the particulars transmitted under the first sentence.
(4) The supervisory authority makes available to the European Insurance and Occupational Pensions Authority, under Article 35 of Regulation (EU) No 1094/2010, on request, without delay, all information necessary for it to perform its tasks under Directive (EU) 2016/2341 and Regulation (EU) No 1094/2010. Without prejudice to Article 35 of Regulation (EU) No 1094/2010, the supervisory authority, on the request of the European Insurance and Occupational Pensions Authority, makes available in good time, on a platform established under Article 152b(1) of Directive 2009/138/EC, all information necessary to enable the platform to function properly. The supervisory authority may, with the consent of all affected supervisory authorities, establish a platform for cooperation under Article 152b(2) of Directive 2009/138/EC.
(5) The supervisory authority informs the European Insurance and Occupational Pensions Authority of all administrative sanctions and other measures in accordance with Article 32(3) and Article 36 of Directive (EU) 2016/97.
