Competent authority in relation to EU regulations

(1) The supervisory authority competent under this Act is also, for undertakings subject to supervision under this Act, 1. the sectorally competent authority within the meaning of Regulation (EC) No 1060/2009, as amended, for undertakings falling within the scope of Regulation (EC) No 1060/2009, 2. the competent authority within the meaning of Regulation (EU) No 1286/2014, as amended, for undertakings falling within the scope of Regulation (EU) No 1286/2014, 3. the competent authority within the meaning of Regulation (EU) 2016/1011, as amended, for undertakings falling within the scope of Regulation (EU) 2016/1011, 4. the competent authority within the meaning of Article 29(4) and (5) of Regulation (EU) 2017/2402 for undertakings falling within the scope of Regulation (EU) 2017/2402, 4a. the competent authority within the meaning of Article 44(2) of Regulation (EU) 2023/2631 of the European Parliament and of the Council of 22 November 2023 on European green bonds and optional disclosures for bonds marketed as environmentally sustainable and for sustainability-linked bonds (OJ L, 2023/2631, 30.11.2023), as amended by Regulation (EU) 2023/2869 (OJ L, 2023/2869, 20.12.2023), for originators falling within the scope of Regulation (EU) 2023/2631, 5. the competent authority within the meaning of Article 14 of Regulation (EU) 2019/2088, 6. the competent authority within the meaning of Article 21(1) of Regulation (EU) 2020/852, 7. the competent authority within the meaning of Article 2, point 18, of Regulation (EU) 2019/1238 for undertakings falling within the scope of Regulation (EU) 2019/1238, 8. the competent authority within the meaning of Regulation (EU) 2022/2554.
(2) The supervisory authority is the competent body under Article 5(1) of Directive 2014/17/EU of the European Parliament and of the Council of 4 February 2014 on credit agreements for consumers relating to residential immovable property and amending Directives 2008/48/EC and 2013/36/EU and Regulation (EU) No 1093/2010 (OJ L 60, 28.2.2014, p. 34; L 47, 20.2.2015, p. 34; L 246, 23.9.2015, p. 11), for the undertakings it supervises.
(3) The authority competent under subsection (1), point 8, cooperates with the Deutsche Bundesbank in carrying out Articles 26 and 27 of Regulation (EU) 2022/2554. The Deutsche Bundesbank performs the operational tasks under Articles 26 and 27 of Regulation (EU) 2022/2554. Section 7(3) and (4) of the Banking Act applies correspondingly.
