The Federal Ministry of Finance is authorised to issue, by statutory instrument, provisions on the nature, scope, timing, and form of the particulars to be submitted under section 17(1) and (2), insofar as this is necessary for the supervisory authority to perform its tasks. For insurance undertakings not subject to supervision by the Länder supervisory authorities, the statutory instrument may provide that interested acquirers must, generally or in individual cases, submit the documents named in section 9(4), point 2, letters c and d, and have them examined, at their own expense, by an auditor to be designated by the supervisory authority. The authorisation may be transferred to the Federal Institute by statutory instrument. Statutory instruments under the first to third sentences do not require the consent of the Bundesrat.
