Principle of proportionality

(1) For insurance undertakings that are not pension funds, the supervisory authority applies the provisions of this Act in a manner appropriate to the nature, scale, and complexity of the risks inherent in the business of the respective insurance undertaking. For pension funds, the supervisory authority applies the provisions of this Act in a manner appropriate to the scale, nature, extent, and complexity of the activities of the respective pension fund.
(2) Subsection (1) applies correspondingly to the body empowered to issue statutory instruments, insofar as this Act authorises the issuing of statutory instruments.
