(1) Where an insurance undertaking with its registered office domestically is directly or indirectly related to an insurance undertaking, a credit institution within the meaning of Directive 2006/48/EC, or an investment firm within the meaning of Directive 2004/39/EC in another member or contracting state, or has a common participating undertaking with such an undertaking, the supervisory authority transmits to the supervisory authority of the other member or contracting state, without delay, the information that enables or facilitates that authority's fulfilment of its supervisory duties within the framework of Directive 2009/138/EC. The information under the first sentence includes in particular information on measures of the group and of the supervisory authorities, and information provided by the group. On request of the supervisory authority of the other member or contracting state, the supervisory authority also transmits information suitable for enabling or facilitating supervision under Directives 2009/138/EC and 2002/87/EC. The supervisory authority also transmits information insofar as this is required by delegated acts of the European Commission under Article 249(3) of Directive 2009/138/EC.
(2) Where the parent undertaking of a group has its registered office in Germany, and the supervisory authority is not the group supervisory authority, the supervisory authority is, on the request of the group supervisory authority, authorised to require from the parent undertaking information on all business matters of the group, and the submission and transmission of all business documents concerning the group that are useful for performing the tasks and powers of the group supervisory authority named in section 281, and to forward these to the group supervisory authority.
(3) The supervisory authority recognises and applies decisions under Article 231(3) or (6) and under Article 237(3) of Directive 2009/138/EC taken by a supervisory authority of another member or contracting state as group supervisory authority.
