(1) An institution for occupational retirement provision engages in cross-border activity where it operates a retirement provision scheme for which the host state is a member or contracting state other than the institution's home state. The host state is the member or contracting state whose social and employment law provisions in the field of occupational retirement provision are applied to the relationship between the sponsoring undertaking and its prospective and current beneficiaries.
(2) Sections 57 to 60 do not apply to pension funds and Pensionsfonds. Sections 61 to 66 do not apply to institutions for occupational retirement provision whose home state is another member or contracting state.
