Duty of confidentiality

Persons employed by, or working for, a protection fund may not, without authorisation, disclose or exploit third-party secrets, in particular trade or business secrets. They must be bound by the Federal Institute, under the Obligations Act of 2 March 1974 (Federal Law Gazette I, pages 469, 547), to the conscientious performance of their duties. There is no unauthorised disclosure or exploitation where facts are passed on to the Federal Institute.
