Allocations to the tied assets

(1) Where the tied assets do not reach the minimum amount under section 125(2), the management board must without delay allocate the missing amount to the tied assets. Allocation to the tied assets may be dispensed with insofar as, abroad, special security must be provided out of the insurance premiums received for the benefit of particular insurance policies.
(2) The supervisory authority may order that amounts beyond the minimum amount under section 125(2) be allocated to the tied assets, where this appears necessary to safeguard the interests of the insured. An allocation may be necessary in particular having regard to the lower current values of the assets of the tied assets.
