Electronic transmission; power to issue a statutory instrument

(1) The Federal Ministry of Finance is authorised to regulate, by statutory instrument not requiring the consent of the Bundesrat, for the area of competence of the Federal Institute, the obligation and the procedure for electronic filing and the use of electronic communication procedures for notifications, filings, reports, applications, and other information, together with the documents necessary for this, that are to be submitted to the Federal Institute
1. under this Act and the statutory instruments issued on the basis of this Act, and
2. under the European Union regulations named in section 295(1), and the acts issued to implement these regulations and Directive 2009/138/EC.
(2) A statutory instrument under subsection (1) may, in particular,
1. lay down which electronic communication procedure is to be used for the respective obligation to file electronically with the Federal Institute, and which provisions apply to its use, including the obligation to have access to an electronic communication procedure within the meaning of sections 4f and 4g of the Financial Services Supervision Act, and
2. lay down more detailed provisions on the nature, scope, time, form, and data format of the filings under subsection (1).
(3) The Federal Ministry of Finance may transfer the authorisation under subsections (1) and (2) to the Federal Institute by statutory instrument not requiring the consent of the Bundesrat.
