Part 2 · Provisions for direct insurance and reinsurance  ›  Division 3 · Investments; tied assets › Section 130

Withdrawal from the tied assets

(1) Apart from the funds required to make and change investments, only amounts that become free through the occurrence or settlement of an insured event, through surrender, or through the termination of an insurance relationship or amendment of the scheme of operations, may be withdrawn from the tied assets.
(2) The holdings of the tied assets may be disposed of by enforcement or attachment only to the extent that allocation to the tied assets under section 125(1) to (3), section 126(3), and section 127 was prescribed and actually made for the claim in whose favour the disposal is made. The first sentence applies correspondingly to set-off against claims belonging to the holdings of the tied assets.
