Applicable provisions

(1) The provisions applicable to life insurance undertakings that are pension funds apply correspondingly to Pensionsfonds, insofar as this Part does not contain derogating rules. In doing so, 1. the pension schemes take the place of the general terms of insurance, 2. the interests of prospective and current beneficiaries take the place of the interests of the insured, 3. the pension relationships take the place of the insurance relationships. Pension schemes are the terms, structured within the scheme of operations, for the scheduled provision of benefits on the occurrence of the pension event.
(2) Section 8(2), section 10(4), section 13(2), section 125(5) and (6), section 139(3) and (4), sections 210, 232, and 233, section 234(3), first, second, and fourth sentences, and (5) to (7), sections 234i and 234j(1) and (4) to (8), sections 235 and 312(4), first, third, and fourth sentences, and (5), second sentence, and section 313 do not apply.
(3) Authorisation to conduct business may be granted only to stock corporations, including the European Company, and to mutual Pensionsfonds associations. The provisions on mutual insurance associations apply correspondingly to mutual Pensionsfonds associations, insofar as nothing else is determined.
(4) In section 140(2), the statutory instrument issued under section 240, first sentence, point 7, takes the place of the statutory instrument issued under section 145(2). In section 141(5), first sentence, points 1 and 2, the principles of the statutory instrument issued under section 240, first sentence, points 10 to 12, take the place of the principles of the statutory instrument issued under section 88(3).
