Amendment of the general terms of insurance

(1) Section 195(1) and (2), subject to subsection (2), applies correspondingly also to amendments of the general terms of insurance.
(2) The articles of association may authorise the management board, with the consent of the supervisory board, to introduce or amend general terms of insurance. Where the management board and the supervisory board are not authorised by the articles of association to amend general terms of insurance, the highest representative body may authorise the supervisory board, where urgently necessary, to amend the general terms of insurance provisionally; the amendments must be submitted to the highest representative body at its next meeting and set aside if it so requires.
(3) An amendment of the articles of association or of the general terms of insurance affects an existing insurance relationship only where the insured expressly consents to the amendment. This does not apply to provisions for which the articles of association expressly provide that they may also be amended with effect for existing insurance relationships.
