Notice of withdrawal by a creditor

(1) A creditor of a member who has obtained the attachment and transfer of a credit due to the member on settlement with the cooperative, after execution against the assets of the member has, within the last six months, proved fruitless, may exercise the member's right of withdrawal in its place. The exercise of the right of withdrawal is excluded for as long as the enforcement instrument is only provisionally enforceable.
(2) The notice of withdrawal must be accompanied by a certified copy of the enforceable exemplification of the instrument, and of the certificates on the fruitless course of execution against the assets of the debtor.
