List of members

(1) The management board is obliged to keep the list of members.
(2) Every member of the cooperative is to be entered in the list of members with the following particulars: 1. family name, first names and address, in the case of legal persons and registered commercial partnerships, firm name and address, in the case of other associations of persons, the designation and address of the association or the family names, first names and addresses of its members; 2. the number of further shares subscribed by it; 3. withdrawal from the cooperative. The statutes may determine what further necessary particulars each member is entered with. The point in time at which the accession, a change in the number of further shares, or the withdrawal, becomes or has become effective, is to be stated.
(3) The documents on the basis of which the entry of the accession, the change in the number of further shares, or the withdrawal in the list of members is made, are to be retained for three years. The period begins with the close of the calendar year in which the member withdrew from the cooperative. In other respects the provisions on the retention of commercial letters in section 257 of the Commercial Code apply to the retention of the documents.
