(1) Where the winding-up of the insolvency proceedings is expected to take a longer time, the insolvency administrator may, with the consent of the creditors' committee, where one has been appointed, and of the insolvency court, distribute the amounts collected under section 110 to the creditors already before the point in time named in section 115(1), by way of interim distribution under sections 187 to 195 of the Insolvency Code. An interim distribution should be omitted insofar as, having regard to the ratio of the debts to the assets, a refund of collected amounts to members under section 105(4) or section 115(3) is to be expected.
(2) Should a surplus nonetheless arise from the insolvency estate after satisfaction of the creditors, the amounts overpaid are to be refunded to the members out of the surplus.
