(1) Every member has the right to end its membership by notice of withdrawal.
(2) Notice of withdrawal may be given only for the close of a business year, and at least three months before its expiry, in text form; the statutes may prescribe written form for the notice of withdrawal. The statutes may determine a longer notice period, of at most five years. At cooperatives in which more than three-quarters of the members are members as entrepreneurs within the meaning of section 14 of the Civil Code, the statutes may, for the purpose of securing the financing of fixed assets, determine a notice period of up to ten years for entrepreneurs.
(3) Contrary to a notice period of more than two years determined in the statutes, every member who has belonged to the cooperative for at least one full business year may end its membership by early notice of withdrawal, where remaining in the cooperative until expiry of the notice period cannot reasonably be expected of it having regard to its personal or economic circumstances. The notice of withdrawal is in that case to be given with a period of three months for the close of a business year for which the member cannot yet give notice under the statutes.
(4) Membership does not end where the cooperative is dissolved before the point in time at which the notice of withdrawal would have become effective. The dissolution of the cooperative does not preclude the termination of membership where the continuation of the cooperative is resolved. In that case, the period during which the cooperative was dissolved is included in computing the notice period; membership ends, however, at the earliest at the close of the business year in which the resolution on the continuation of the cooperative is entered in the register of cooperatives.
(5) Agreements that infringe the foregoing subsections are void.
