Section 160

Coercive-fine procedure

(1) The members of the management board are to be compelled by the registry court, by the fixing of a coercive fine, to comply with the provisions contained in sections 14, 25a, 28, 30, 32, 54, second sentence, section 57(1), section 59(1), section 78(2), section 79(2). In the same manner, the members of the management board and the liquidators are to be compelled to comply with the provisions contained in section 33(1), second sentence, section 42(1) in conjunction with section 53 of the Commercial Code, sections 47, 48(3) and (4), fourth sentence, section 51(4) and (5), section 56(2), sections 84, 85(2), section 89 of this Act, and the members of the management board and the supervisory board and the liquidators are to be compelled to ensure that the cooperative is not, subject to section 9(1), second sentence, without a management board, or without a supervisory board capable of adopting resolutions, for longer than three months. The individual coercive fine may not exceed the amount of five thousand euros.
(2) For the procedure, the provisions governing the enforcement of the applications for registration in the commercial register ordered in the Commercial Code are decisive.
