Distribution of profit and loss

(1) The profit or loss of the business year arising for the members on the determination of the annual financial statements is to be distributed among them. Distribution takes place, for the first business year, in the ratio of their payments made on the share, and for each following year, in the ratio of their credit balances as ascertained by the crediting of profit or the debiting of loss at the close of the preceding business year. The crediting of profit continues for as long as the share has not been reached.
(2) The statutes may lay down another basis for the distribution of profit and loss and determine to what extent profit is to be paid out to the members before the share is reached. Until a credit balance reduced by loss has been restored, no payment of profit takes place.
