Section 112

Procedure on the action of contestation

(1) The action is to be brought exclusively at the local court that declared the calculation enforceable. The oral hearing does not take place before expiry of the peremptory period stated. Several contestation proceedings are to be joined for simultaneous hearing and decision.
(2) Where the subject matter of the dispute in a proceeding exceeds the sum otherwise applicable to the subject-matter competence of the local courts, the court must, where a party in such a proceeding applies for this before the hearing on the merits, refer all the disputed matters, by order, to the regional court in whose district it has its seat. Immediate appeal lies against this order. The peremptory period begins with the pronouncement of the order.
(3) Where the order is final and binding, the disputed matters are deemed pending at the regional court. The costs arising in the proceedings before the local court are treated as part of the costs arising at the regional court, and are deemed costs of one instance.
(4) Sections 769 and 770 of the Code of Civil Procedure, on the stay of execution and the setting aside of enforcement measures, apply correspondingly.
