Transitional provision on the Accounting Law Modernisation Act

(1) Section 36(4) and section 38(1a), second sentence, in the version of the Accounting Law Modernisation Act of 25 May 2009 (Federal Law Gazette I p. 1102), do not apply for as long as all members of the supervisory board and the audit committee were appointed before 29 May 2009.
(2) Section 53(3), in the version of the Accounting Law Modernisation Act of 25 May 2009 (Federal Law Gazette I p. 1102), is to be applied for the first time from 1 January 2010.
