Section 93

(1) Whoever, on a commercial basis, assumes on behalf of others the procurement of contracts concerning the purchase or sale of goods or securities, or concerning insurance, carriage of goods, chartering of ships or other commercial matters, without having continuing authority to do so by virtue of a contractual relationship, has the rights and duties of a commercial broker.

(2) The provisions of this Division do not apply to the procurement of business other than that specified above, particularly to the procurement of business concerning immovable property, even if such negotiation is effected by a commercial broker.

(3) The provisions of this Division also apply if the commercial broker’s enterprise, by reason of its nature or size, does not require a commercially organised business operation.
