(1) An insurance agent is a person who, as a commercial agent, is entrusted with the procurement or conclusion of insurance contracts.
(2) The agency contract between the insurance agent and the insurer is governed by the provisions applicable to the agency contract between the commercial agent and the trader, subject to subsections (3) and (4).
(3) In derogation from section 87 (1) sentence 1, an insurance agent is entitled to a commission only for transactions which are attributable to their efforts. Section 87 (2) does not apply to insurance agents.
(4) The insurance agent is entitled to a commission (section 87a (1)) as soon as the insured party has paid the premium on the basis of which the commission is calculated pursuant to the agency contract.
(5) The provisions of subsections (1) to (4) apply accordingly to agents of Bausparkassen [building and loan societies].
