(1) The provisions applicable to merchants also apply to commercial companies and commercial partnerships.
(2) The rights and duties of an association on which the law confers merchant status irrespective of the purpose of the enterprise remain unaffected, even if the pre-requisites of section 1 (2) are not fulfilled.
