The requirements as to form set out in section 766 sentences 1 and 2, in section 780, and in section 781 sentences 1 and 2 of the Civil Code do not apply to a suretyship, to a promise to fulfil an obligation or to an acknowledgment of debt, insofar as the suretyship on the part of the surety, or the promise or the acknowledgement on the part of the debtor, is a commercial transaction.
