Section 396

(1) The commission agent may demand the commission when the respective transaction has been executed. If the transaction has not been executed, then the commission agent nevertheless will be entitled to a delivery commission to the extent that such commission is locally customary; the commission agent likewise will be entitled to demand commission if the execution of the transaction they concluded does not take place solely because of a reason given in the person of the principal.

(2) The reimbursements payable by the principal for the commission agent’s expenditures pursuant to sections 670 and 675 of the Civil Code also include remuneration for the use of storage space and the commission agent’s means of transport.
