Turning over and returning the ship; maintenance

(1) The owner is to turn the ship over to the charterer at the time and location agreed, in a condition suitable for the contractually agreed use.

(2) For the duration of the charter period, the charterer is to maintain the ship in a condition suitable for the contractually agreed use. Upon the charter relationship ending, the charterer is under obligation to return the ship in the same condition, with due account being taken of the wear and tear resulting from use in accordance with the terms of contract.
